Una vergogna che vorrebbe ledere il diritto garantito dall'articolo 32 della nostra Carta costituzionale. Come una vergogna per la chiesa fu quella di aver negato i funerali a Welby.

Alla faccia del rispetto dei patti tra stato e chiesa. Dopo che la suprema Corte costituzionale (la cupola della mafiosità partitocratica la chiama Pannella) ha dichiarato inammissibile l'istanza presentata dal Parlamento per bloccare le sentenze che hanno, negli anni, più volte dato ragione alla famiglia di Eluana, si è arrivati al colmo. Continua a ripetere: Eluana è morta in quell'incidente il 18 gennaio 1992, parla di protocolli della rianimazione, parla un linguaggio innaturale per un padre, forse di un medico o di un avvocato o di un amico, ma dove sono le parole del padre? chiama inferno la vita... e liberazione la morte: ma è viva o è morta?

Speriamo non sia così in uno Stato che vuol dirsi di diritto", molto bene, vedo che anche l'autore di quest'articolo non conosce affatto la nostra costituzione, vediamo perché:

La Repubblica tutela la salute come fondamentale diritto dell'individuo e interesse della collettività, e garantisce cure gratuite agli indigenti.

Nessuno può essere obbligato a un determinato trattamento sanitario se non per disposizione di legge. La legge non può in nessun caso violare i limiti imposti dal rispetto della persona umana.

Ora, per la cronaca, i padri della costituzione avevano ben chiaro il senso di quest'articolo. Scritto nel 1947, ai tempi in cui le vite umane venivano usate come "cavie" per gli esperimenti negli ospedali militari e civili di quel tempo. Pertanto tutta la costituzione è protratta in un solo senso "proteggere la vita", difatto si dice: "La Repubblica tutela la salute come fondamentale diritto dell'individuo", difendere la salute vuol dire anche difendere la vita, facciamo la prova del 9 come a scuola: con la morte dell'individuo (es. Eluana) si può dire che difendiamo la sua salute? NO, è ovvio.

Bene, andiamo avanti:

Cosa volevano dire con "se non per disposizione di legge" ? si fa prima a spiegarlo con un esempio: sono le vaccinazioni (quelle obbligatorie per legge), è il TSO (trattamento sanitario obbligatorio: il ricovero forzato nei reparti pscichiatrici degli ospedali), e cosi via.

Passiamo all'ultima definizione: "La legge non può in nessun caso violare i limiti imposti dal rispetto della persona umana", nuovamente questa dichiarazione, partendo sempre dal punto di vista di "preservare la vita" (art. 2 - diritti inviolabili dell'uomo) rafforza quanto detto sopra.

Tutto questo, per dire che il senso della dichiarazione fatta dall'autore è corretto sulla legge: peccato che se il fine a cui porta l'interpretazione non è per la VITA, ma bensi per la MORTE, violando oltresì con la morte l'art. 2 - diritti inviolabili dell'umo, si comprende come sia scorretto appellarsi a quest'articolo della costituzione per chiedere il rispetto delle proprie volontà, se poi queste condurranno a non rispettare la vita.

Facciamo un'altro esempio: il popolo chiama Eroe colui che mette a rischio la propria vita per salvare quella di un'altro, non l'assassino che commette un omicidio (consenziente): avete visto per caso medaglie sul petto dei medici che hanno "ucciso" Welby: No, è ovvio.

Da questo, potrere inoltre comprendere, come sia stata commessa un ingiustizia da parte della Suprema Corte, ammettendo di poter sospendere l'alimentazione ad Eluana, trascurando il fatto "banale" che senza l'alimentazione artificiale (che non è un trattamento terapeutico) e senza assicurasi prima che Eluana possa nutrisi naturalmente si rischia proprio di violare uno dei diritti inviolabili dell'uomo: la sua stessa vita.
